Please take the time to read and understand the terms and conditions of travel set out below prior to confirming your reservation with us. OUTBACK OPAL TOURS recommend you read and understand the specific health and fitness requirements for the tours you intend to undertake.
All bookings are made with OUTBACK OPAL TOURS Pty Ltd (ABN 31 1 460 702 77) and by booking a tour with us you agree to have read and accepted these Terms and Conditions.
Dates, itineraries, and prices are valid from 1st April 2019. All prices are in Australian Dollars and include GST. All prices and conditions are subject to change without notice.
THINGS YOU SHOULD KNOW
Our group sizes vary from a maximum of 6 – 20 passengers depending on the tour. The maximum group size for each tour is listed on the itinerary. There is a minimum of 6 guests for our TOWN TOUR and for our FULL DAY TOUR.
Multiple tour discounts of tours available.
All bookings must be paid for in full when getting on our bus and starting your tour. Reservations can be made directly with us by phoning 02 6829 4110. You can also book via our website www.outbackopaltours.com.au or with your friendly staff at all Lightning Ridge accommodation places.
For payments, we do accept CASH or CARD PAYMENT on our buses. Pre-payments can be arranged and gift vouchers can be purchased via our website. Please contact our office for further information and/or to make arrangements.
CANCELLATION BY YOU
Due to the extensive planning and costs associated with touring, the following cancellation fees will apply in the event you should cancel for any reason.
- Town Tour – same day to departure – 50% of the total price
- Full Day Tour – 1 day prior to departure – 30% of total price
- Full Day Tour – same day to departure – 50% of total price
For any overseas guests travel Insurance is compulsory and not part of our tour/included in our tour price.
We accept no responsibility for lost, stolen, or damaged property.
CANCELLATION BY OUTBACK OPAL TOURS
At times OOT may have to cancel a tour or service. In the event we do have to cancel, every effort will be made to offer a suitable alternative. If the alternative is not suitable, we will refund your tour price in full in case any payment has been made before the start of your tour. We reserve the right to cancel a tour if group numbers are insufficient or combine tours/groups in the event that low numbers endanger a scheduled departure being canceled. OOT reserves the right to have multi-level pricing on products where it is necessary. Where the cancellation is due to external factors beyond our control, any potential refund will be less any unrecoverable cost that we may have incurred.
BOOKING AMENDMENTS GROUP TOURS/COACH BOOKINGS
Due to the complexity, staff time, and communication costs of the booking process, the following amendment charges will apply:
8 + days prior to departure 10% (including GST) on the full price of the groups
Changes made within 7 days of the scheduled tour – 50% cancellation fee of group price will occur
RECONFIRMING YOUR TOUR
We do send a text message after booking one of our tours via phone. If you make a booking by sending us an email we will email you a booking confirmation and/or send you a booking confirmation as a text message once we can confirm the tour with you. The booking confirmation states which tour you have booked with us, your pickup point (specified by you), the number of passengers for the tour, and the date of your tour.
If you need to make any changes to your booking please contact us as soon as possible. Please call 02 6829 4110 (within Australia) or +61 2 6829 4110 (outside Australia). OOT will not be held responsible for any costs incurred due to changes in pick-up details if re-confirmation is not made.
WHAT YOU WILL NEED TO BRING (RECOMMENDATION)
A hat, sunscreen, insect repellent, fly net (summer), medication (if required), a water bottle, enclosed shoes/walking shoes/boots, warm clothing (winter), money for drinks in bush pubs on our FULL DAY TOUR if you wish to have other drinks than tea/coffee and water (provided), in case of rain it can get really muddy very quickly in Lightning Ridge and surrounding – please wear appropriate shoes which you don’t mind if they get dirty.
OOT understands the importance of protecting your privacy. Any information we collect from you may be used for any purpose associated with delivering our tours. We may from time to time have to pass your details on to our agents, service providers, or other suppliers to enable us to deliver our service. We educate all of our staff about the requirements of the National Privacy Principles and the Privacy Act.
HEALTH AND MEDICAL REQUIREMENTS
Due to the location of Lightning Ridge and the distances traveled on our tours (this mainly is the case on our FULL DAY TOUR to the Glengarry, Sheepyard, and Grawin Opal Fields about 80 km from Lightning Ridge) we may be hours from medical facilities. It is the responsibility of you to declare any known medical condition(s) at the time of booking. OOT reserves the right to request additional information and/or medical clearance (at your own expense) before confirming your reservation.
We part of our condition of entry, we only take guests on tour who are feeling healthy and have no fever, cough, or other symptoms of COVID-19.
Upon joining your OOT tour we require you to re-confirm any medical condition(s) to your guide and enough medication should be carried for the duration of your tour.
As part of our TOWN TOUR, you are going underground into the Walk-In Mine. There is a flight of stairs leading down to go underground and you do need a certain physical ability to go down and come back up. There is no lift available going down or back up and it is your responsibility to wear the provided helmet, wear suitable footwear, and take the stairs slowly and carefully. They might appear slippery due to the development of moister underground. Parents are responsible for their children at all times and have to supervise carefully at all times.
A certain level of fitness is required for our tours. To ensure that you enjoy your time on tour with us, you should be able to walk over rough, uneven ground.
If you are unable to meet the required level, you must disclose this at the time of booking. In the interests of health and safety, OOT reserves the right to refuse travel due to any medical conditions and/or fitness level that we deem necessary. OOT will not be liable for any additional expenses or cancellation fees imposed by ourselves or third parties incurred as a result of refusal to travel due to non-disclosure.
DIETARY REQUIREMENTS AND FOOD ALLERGIES
If you have any food allergies or specific dietary needs please contact us to discuss these requirements and we will advise you if they can be catered for. As we operate in remote parts of Australia, certain foods are not always readily available. We may have to supplement our menus as supply dictates therefore we cannot guarantee all ingredients contained in these alternatives. In these instances, we will advise you to provide your own supplementary food/ snacks depending on your specific requirements.
CHANGE OF ITINERARY
OOT reserves the right to amend tour times, itineraries, and fares for its products as circumstances, time of year and operational reasons occur. There will be no refunds in these circumstances nor for delays incurred due to mechanical failure, accident, weather, or any other unforeseen circumstances. We cannot guarantee exact pick-up and drop-off times and will accept no responsibility in the event of cancellation fees from other connecting services. In the event of a location or host not being available alternative experiences of a similar nature will first be sought and failing this, refunds will be offered for this component only. No compensation will be considered for any additional driving or time lost due to such changes.
ACCEPTANCE OF RISK
Australia has many dangerous creatures, extreme weather conditions, and often varying terrain. Camping, hiking, and passing time outside may increase your personal risk of exposure to these dangers. Safety is our number one priority and all of our guides are highly trained to ensure passenger safety at all times. All passengers participating in our tours do so at their own risk and no responsibility can be accepted by OOT for any loss, injury, or accident. Passengers are responsible for any additional costs involved should such instances occur. The minimum age for children traveling is 5 years at the time of travel. All passengers under the age of 18 must be accompanied by an adult or caregiver at all times. While all care is taken, the responsibility of children on tour rests entirely with the parent or caregiver. All passengers, including children, must wear shoes at all times, use sunblock, and wear hats.
LIMITATION OF LIABILITY
We contract with a network of companies and individuals to assist in operating our tours. OOT works with the best operators available but takes no responsibility for any act of neglect by any operator whose services are used as part of your tour. Our suppliers make every effort to safeguard clients, and we cannot be held responsible for personal injury or sickness to any customer which is beyond our control.
Passengers should note that travel in the outback/remote areas and unsealed roads involves a higher than normal risk and a signed release may be required from all participants from a number of our activity providers.
AUTHORITY ON TOUR
We pride ourselves on the very high standard of our guides. All guides have a sound knowledge of the local area focusing on its history, Aboriginal culture, geology, and the natural environment.
Passengers must abide by the tour guides’ instructions and directions at all times, in particular with regard to actions and behavior in areas with elevated hazards or risks and emergency situations. Non-compliance with any directions from the tour guide or other authority may result in the passengers being refused onward travel with no right to refund. All vehicles are fitted with a microphone and VMD (vehicle monitoring device) and OOT will ensure to the best of its ability to have them all in good working order. Due to the environment in which we are traveling, heat, humidity, and dust often have an adverse effect on electronics within the vehicles, and as such their use cannot be guaranteed. In such instances, guides will make every effort to ensure commentary of significant importance is heard by all but no compensation will be due in the event that it is not.
PHOTOS AND MARKETING
You consent to us using images of you taken during the trip for advertising and other promotional purposes in any medium we require. You agree that the use of these images is without recourse to you and without compensation to you.
If you have any feedback regarding your trip please inform your tour guide at the time so they can try and rectify the issue.

The laws of New South Wales, Australia govern these terms and conditions. Any disputes in connection with a tour or these terms and conditions must be initiated in the courts of New South Wales, Australia.
PLEASE FIND THE FOLLOWING INFORMATION /SUMMARY FOR OUR GUESTS ALSO ON OUR BUSES:
Conditions of our tours, safety requirements, and assumption of risk. Some important information for you to keep you safe on all our tours
- Please keep within the group on our tours and within sight of your tour guide
- Parents are responsible for their children and are to supervise them at all times
- If our buses are fitted with seatbelts they must be worn for your safety whenever the bus is moving
- Please watch your head and step getting on and off the bus. If you need a hand we are here to help.
- We have to ensure that you are wearing enclosed shoes (no high heels or thongs) as a Mines Department requirement when going underground and because we do stop at various places with uneven surfaces and rougher ground.
- Please be cautious and take care wherever you walk. We are in a mining area and the risk of slips, trips, and falls is very high
- Please inform us of any medical conditions you feel we should know of. For our tours, you will need a low to moderate fitness level
We are in phone range most of the time on all of our tours but due to being a small country town we have limited medical services and immediate help might reach us with some delay which you wouldn’t experience in a city. Should this be a concern for you please let us know before we start the tour.
- WALK-IN MINE (Opal Mine Adventure) – Safety brief for guests before we go underground on-premises
In case of an emergency please stay calm and listen to the instructions of your tour guide. Exit the hazard area if possible and safe to do so. Buses are fitted with first aid kits to treat any minor injuries. Both of our buses are also equipped with a VMD (Vehicle Monitoring Device).
SUMMARY OF RIGHTS AND OBLIGATIONS OF PASSENGERS
When traveling in company vehicles:
Passengers must not:
- Place feet on seats
- Smoke, and or spit
- Use offensive language or behave offensively
- Interfere with equipment or damage the bus
- Throw anything in or from the bus
- Drop/leave rubbish on the bus
- Expect the bus to be clean and tidy
- Expect to see the driver’s authority card displayed
- Expect not to be inconvenienced by any luggage or goods within the bus
- Expect the driver to behave in an orderly manner, act with civility and propriety, and comply with reasonable requests
- Drink water on the bus
INSURANCE WAIVER FOR ALL GUESTS
In light of the unique mining environment featured in our tours, including the guided underground section of our Town Tour, all guests are obliged to complete and sign an insurance waiver form on the day of their tour. This waiver is an essential part of ensuring the safety and enjoyment of our experiences. By participating in our tours, you acknowledge and agree to this requirement.

By signing this agreement, you confirm your understanding and voluntary agreement to acknowledge and accept the following terms for participation in the tour organized by Outback Opal Tours:
- Assumption of Risk: You understand and willingly accept the inherent risks of the tour, including personal injury, property damage, and exposure to natural elements and wildlife.
- Waiver of Liability: You release Outback Opal Tours, its employees, representatives, and agents from any liability for injuries, damages, or losses, whether due to negligence or other factors.
- Health and Fitness: You certify that you are physically and mentally fit for the tour and agree to inform Outback Opal Tours of any medical conditions or limitations.
- Compliance: You agree to follow all instructions provided by Outback Opal Tours and its guides; non-compliance may result in removal from the tour without a refund.
- Media Release: You grant permission for Outback Opal Tours to use tour-related photographs and recordings for promotional purposes.
- Severability: If any part of this waiver is invalid, the remaining provisions remain in effect.
- Governing Law: This waiver is governed by the laws of New South Wales, Australia
